Please read these Terms and Conditions (“Agreement”) carefully before using Topaz Media Digital Signage Service at https://topaz.media, and https://app.topaz.media provided by TMAG company LTD (Larnaca, Cyprus). You may use Topaz Media Digital Signage Service (“Service”) only if you agree with these Terms & Conditions and all applicable local, state, national laws of Cyprus and international rules, regulations & laws. At the moment our service works only with individuals (not with companies).
Privacy
All the information which you give us on our site or via e-mail is confidential & save. We can use your data only to give you better response and to make service usage more convenient. We will not share, sell or give anybody access to this data, unless you ask us to do it to fulfill your requirements (for example to ship an order). We can contact you using your contacts to inform you about your contracts, digital signage news or service changes. You may cancel these contacts at any time by informing us via e-mail info@topaz.media.
Subscription plans
Plan FREE costs 0€ and can be used forever. Plans PRO and Corporate should be paid with any convinient way: credit card, Paypal or Apple Pay, if it is possible in your country. Subscription should be paid in advance. There will be no refunds or credits for partial months of service, refunds for upgrade/downgrade, or refunds for unused months with an open account. All fees are exclusive of all taxes, levies, or duties imposed by taxing authorities, and you shall be responsible for payment of all such taxes, levies, or duties, except for Cyprus taxes.
Stop service usage
We may stop your access to the Service, without cause or notice, which may result in the forfeiture and destruction of all information associated with you.
Third party sites
The Service contains links to third-party sites that are not owned by TMAG COMPANY LTD, but not responsible for their content and service. We strongly recommend to read terms & conditions of any third-party site that you visit.
Player License
Topaz media player and other downloaded software can only be used in conjunction to the Service. License to use Topaz Media Player software is revoked upon account termination.
Limitation Of Liability
TMAG COMPANY LTD is not responsible for damages, direct or consequential, resulting from your use of the Service.
Warranty Disclaimer
Your use of the Service is at your own risk. The Service is provided on an “as is” and “as available” basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance. We do not warrant that the Service will function uninterrupted, secure or available at any particular time or location; any errors or defects will be corrected; the Service is free of viruses or other harmful components; or the results of using the Service will meet your requirements.
Governing Law
This Agreement (and any further rules, polices, or guidelines incorporated by reference) shall be governed and construed in accordance with the law of the Cyprus. You agree to submit to the exclusive jurisdiction of the Cyprus.
Changes To This Agreement
Topaz Media service reserves the right, at its sole discretion, to modify or replace these Terms of Service by posting the updated terms on the Service. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms of Service. Please review this Agreement periodically for changes. If you do not agree to any of this Agreement or any changes to this Agreement, do not use or access the Service or discontinue any use of the Service immediately. Scope
The present Terms and Conditions form the legal basis for the relations between Topaz Media and you with regard to the service Topaz Media Digital Signage.
Registration and Conclusion of the Agreement
The contract is concluded by accepting an offer which is typically available on the website of Topaz Media, by explicit acceptance or offer accordingly ordering. The order of services requires an effective registration of the customer; therefore the customer needs to have an account.
Description of Services, Subject of the Agreement
All services provided by Topaz Media in connection with the Topaz Media Digital Signage service are provided exclusively on the basis of these Terms and Conditions. Any provision that deviates from these Terms and Conditions, in particular any Terms and Conditions of the Customer, is only valid if confirmed in writing by Topaz Media.
License and Copyright of Material
Copyright. The copyright to the entire Topaz Media material remains the property of Topaz Media or the third-party sources, in so far as such have been identified. Images and video material. If images and/or video material are used without the templates created by Topaz Media, the images and/or video material must be clearly and distinctly labelled with the copyright and/or agency notice. As a rule, in the case of images and video material, only the simple right of use to the copyright is transferred. No representation is made that the holders of the rights to depicted works of fine or applied arts or the holders of trademarks and other proprietary rights have granted their consent to any public reproduction, in particular, for use in advertising. The User is responsible for obtaining the consent necessary in each individual case.
