At the moment our service works only with individuals (not with companies).

  • License to Topaz Media: By submitting your content to the Service, you grant Topaz Media a non-exclusive, royalty-free, worldwide license to use, reproduce, modify, distribute, and publicly display your Presentations solely to provide the Service to you.
  • Third-Party Content: If your content includes materials from third-party sources, you are responsible for ensuring that you have the appropriate licenses or permissions to use such content on the Service.

5. Prohibited Content and Conduct

  • Violations of Intellectual Property: Do not upload or share content that infringes on third-party copyrights, trademarks, or other intellectual property rights.
  • Harmful Content: You must not upload content that:
    • Harasses, defames, or threatens others.
    • Contains malware, viruses, or any other harmful software.

15. Use of Content from Third-Party Platforms (YouTube, Google, Pixabay, TikTok, Facebook, Instagram, and Others)

15.1 User-Generated Content from Third-Party Platforms

  • You may choose to incorporate content from third-party platforms, including but not limited to YouTube, Google, Pixabay, TikTok, Facebook, Instagram, and other social media and media platforms ("Third-Party Platforms"), into your Presentations or other content on the Service. By doing so, you agree to comply with the respective terms and conditions and licensing policies of such Third-Party Platforms.
  • You are solely responsible for ensuring that you have the necessary rights, licenses, or permissions to use, display, and distribute any third-party content you incorporate into your Presentations or other materials. Topaz Media does not own or control the content provided by these Third-Party Platforms, and we make no representations regarding the accuracy, legality, or availability of such content.

15.2 Content from YouTube

  • If you use YouTube videos or other content hosted on the YouTube platform in your Presentations:
    • You must comply with YouTube's Terms of Service and YouTube's Community Guidelines.
    • You must not violate YouTube’s policies, including restrictions on downloading content without authorization, using content for commercial purposes without permission, or otherwise infringing on copyrights, trademarks, or other intellectual property rights.
    • Any content retrieved or embedded from YouTube remains governed by YouTube’s licensing and terms, and Topaz Media does not grant any rights to such content beyond its original license terms.

15.3 Content from Google

  • If you incorporate any content from Google, including Google Images, Google Videos, Google Maps, or other Google services:
    • You must comply with Google’s Terms of Service and Google’s Copyright Policy.
    • You are responsible for ensuring that you have the appropriate rights, licenses, or permissions to use any Google-owned content.
    • You must not infringe any intellectual property or other rights of Google or third parties.

15.4 Content from Pixabay

  • If you use images, videos, or other content from Pixabay, you agree to comply with Pixabay's License Terms, which grant you a royalty-free license to use the content in your Presentations. However, you must adhere to the following restrictions:
    • You may not use the content in a way that implies endorsement or association with any product, service, or company unless you have explicit permission.
    • You must not use the content in any unlawful or defamatory manner.
    • You may not redistribute the content as standalone files.

15.5 Content from TikTok

  • If you use TikTok videos or other content hosted on the TikTok platform in your Presentations:
    • You must comply with TikTok's Terms of Service and TikTok's Community Guidelines.
    • You may not download, redistribute, or modify TikTok content without the appropriate permission.
    • Content embedded or shared via TikTok retains TikTok’s copyright, and you must comply with their intellectual property policies.

15.6 Content from Facebook and Instagram

  • If you incorporate any content from Facebook or Instagram, including posts, videos, images, or other content shared via these platforms:
    • You must comply with Facebook's Terms of Service, Instagram's Terms of Service, and their Community Guidelines.
    • You may not download, redistribute, or use Facebook or Instagram content for commercial purposes unless the content owner provides you with the appropriate permissions.
    • You are responsible for ensuring that the use of Facebook or Instagram content does not infringe upon the rights of others, including intellectual property rights, privacy rights, and likeness rights.

15.7 Content from Other Third-Party Platforms

  • If you use content from any other Third-Party Platform (such as Vimeo, Flickr, SoundCloud, Twitter, Snapchat, etc.):
    • You must ensure compliance with the specific Terms of Service and Community Guidelines of each platform.
    • You are solely responsible for obtaining the necessary licenses, permissions, or rights to use the content from these platforms, and Topaz Media is not liable for any content misuse.
    • You may not use such content in any way that violates the intellectual property or rights of the platform, content creators, or third parties.

15.8 General Guidelines for Using Third-Party Platform Content

  • No Unauthorized Use: You agree not to download, modify, distribute, or otherwise use any third-party content from these platforms unless specifically authorized to do so by the platform or the content owner. You must not circumvent any digital rights management (DRM) or other security measures that protect content from unauthorized use.
  • Attribution and Credits: Where required, you must provide proper attribution and credits to the original content creators or platforms in accordance with the licensing terms of the Third-Party Platforms.
  • No Alteration or Misrepresentation: You agree not to alter or misrepresent any content from third-party platforms in a manner that could mislead others or violate the rights of the content creator or platform.

15.9 Liability for Third-Party Content

  • Topaz Media is not responsible for the availability, legality, or quality of any third-party content, including content sourced from platforms such as YouTube, Google, Pixabay, TikTok, Facebook, Instagram, and others. You acknowledge and agree that:
    • Topaz Media has no control over such content and is not liable for any damages arising from its use.
    • Any disputes, claims, or legal issues arising from the use of third-party content must be resolved directly with the respective platform or content owner.
    • You indemnify Topaz Media and hold it harmless for any claims related to the use or misuse of third-party content, including but not limited to infringement of intellectual property rights, privacy rights, or any other third-party claims.

16. Compliance with Copyright Laws and Licensing Requirements

  • You are responsible for ensuring that all content you upload, display, or distribute via the Service complies with applicable copyright, trademark, and intellectual property laws. This includes content sourced from third-party platforms like YouTube, Google, Pixabay, TikTok, Facebook, Instagram, and others.

17. User-Submitted URLs and Scraped Content

  • By using the Service, you acknowledge and agree to the following terms regarding the submission of URLs and the scraping of content:

  • You are solely responsible for any URLs you submit to the Service. By submitting a URL, you represent and warrant that:
    • You have the necessary rights or permissions to use, display, and distribute the content hosted at the URL.
    • The content linked from the URL does not infringe upon the intellectual property rights, privacy rights, or any other legal rights of third parties.
    • The content linked to does not violate any third-party Terms of Service, including but not limited to the scraping or redistribution prohibitions outlined by the website’s owner.

17.2 Scraping and Redistribution of Content

  • The Service may automatically scrape video content from the URLs you provide. By submitting a URL, you agree that:
    • The Service may copy and store video content from the URL in its internal storage for the purpose of providing content playback to you and other users.
    • You are solely responsible for ensuring that the content being scraped does not violate the copyright, trademark, or other intellectual property rights of the website or its owners.
    • The Service does not grant you any ownership rights in the content scraped from third-party websites, and the Service does not make any representations regarding the legality or availability of such content.
